Privacy Policy

This Privacy Policy explains how Zhivaya Rech (“Живая речь,” “we,” “us,” or “our”) collects, uses, and discloses information when you use our website at zhivayarech.com and our related educational services, whether online or in person (collectively, the “Service”). By using the Service, you agree to this Privacy Policy. If you do not agree, please do not use the Service.

Who this policy is for

Our Service is intended for use by parents and legal guardians (“you”) who create an account, enroll children in our programs, and manage their participation. Our programs are designed for young children, but accounts and information are provided to us by adults, not by children directly. How we handle information specifically about enrolled children is described below under “Children’s Information” and in our separate Children’s Privacy & Parental Consent Notice, which forms part of this Policy.

Information we collect

Information you provide to us:

  • Account information. When you register, we collect your name, email address, and (if provided) phone number. We use passwordless “magic link” sign-in by email and do not store account passwords for parent accounts.
  • Child profile information. When you add a child to your account, you provide information about that child, such as their name, age or date of birth, and enrollment-related details, along with any additional information you choose to share. You provide this information as the child’s parent or legal guardian.
  • Enrollment and scheduling information. Courses, groups, sessions, waitlist status, and attendance-related records.
  • Payment information. Payments are processed by our third-party payment processor, Stripe. We do not collect or store full payment card numbers, CVV codes, or bank credentials on our systems. We receive limited transaction information from Stripe (such as payment confirmation, card brand or last digits, and subscription status) needed to manage your enrollment.
  • Communications and consents. Records of agreements you accept (such as the Terms of Service, this Privacy Policy, child-data consent, waivers, and marketing preferences), including the version accepted and a timestamp, and any messages you send us through contact forms.
  • Marketing preferences. Whether you have opted in to receive marketing or newsletter emails.

Information collected automatically: When you use the website, we and our infrastructure providers may automatically collect technical information, including your IP address, browser type, device and operating system information, pages viewed, and access dates and times. We use cookies and similar technologies as described in our Cookie Policy.

How we use information

We use the information we collect to create and manage your account and your children’s profiles; process enrollments, waitlists, payments, and subscriptions; communicate with you about your account, enrollments, schedules, and important service or legal notices; send marketing or newsletter emails only if you have opted in (and allow you to opt out at any time); operate, secure, maintain, and improve the Service; maintain records required for our legitimate business, accounting, and legal-compliance purposes; and comply with applicable law and enforce our Terms of Service.

Children’s Information

Our programs serve young children, and we take children’s privacy seriously. We do not knowingly collect personal information directly from children. Information about an enrolled child is provided to us by that child’s parent or legal guardian through the parent account. Consistent with the federal Children’s Online Privacy Protection Act (COPPA, 15 U.S.C. §§ 6501–6506), we obtain parental consent before collecting a child’s personal information, and we limit collection to what is reasonably necessary to provide our services.

If you believe we have collected information about a child without appropriate parental consent, please contact us at info@zhivayarech.com and we will promptly delete it.

How we share information

We do not sell, rent, or trade your personal information or your child’s personal information. We share information only as follows:

  • Service providers who perform services for us under contract and may use the information only to provide those services: Stripe (payment processing and subscription billing), Resend (transactional and, if opted in, marketing email), Cloudflare (DNS, content delivery, and security), and our hosting provider (operating the servers on which the Service runs).
  • Legal and safety: when required by law, subpoena, or legal process, or to protect the rights, safety, or property of our students, families, staff, or the public.
  • Business transfer: in connection with a merger, acquisition, or sale of assets, subject to this Policy.

Payment processing

Payments are handled by Stripe, a PCI-DSS-compliant payment processor, whose handling of your payment information is governed by Stripe’s own privacy policy. We do not store full card data on our systems.

Email and marketing communications

We send service-related emails (such as sign-in links, enrollment confirmations, payment receipts, and important notices) as a necessary part of providing the Service. We send marketing or newsletter emails only to those who opt in. You can withdraw marketing consent at any time using the unsubscribe link in those emails or by contacting us; withdrawing marketing consent does not stop essential service emails.

Data retention

We retain personal information for as long as your account is active and as needed to provide the Service, and thereafter as required for our legitimate business, accounting, tax, and legal-compliance purposes. Consent and agreement records are retained as evidence of acceptance. When information is no longer needed, we delete or de-identify it. You may request deletion as described below.

Data security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including transport encryption (HTTPS) and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your choices and rights

You may review and update your account and your child’s profile information through your parent account; request access to, correction of, or deletion of personal information we hold about you or your child; and opt out of marketing communications at any time. To make a request, contact us at info@zhivayarech.com. We may need to verify your identity before acting on a request.

Your California privacy rights

If you are a California resident, the following apply.

“Shine the Light” (Cal. Civ. Code § 1798.83). You may request information about our disclosure, if any, of personal information to third parties for those third parties’ direct marketing purposes. As stated above, we do not share personal information with third parties for their own direct marketing. To make a request, contact us at info@zhivayarech.com and indicate that you are a California resident.

California minors (Cal. Bus. & Prof. Code § 22581). A registered user under 18 who is a California resident may request removal of content or information they have publicly posted on the Service by contacting us at info@zhivayarech.com.

CCPA/CPRA rights. To the extent the California Consumer Privacy Act, as amended (Cal. Civ. Code § 1798.100 et seq.), applies to us, you have the rights to know, access, correct, and delete your personal information, and not to be discriminated against for exercising these rights. We do not sell or “share” (for cross-context behavioral advertising) personal information, and in particular we do not sell or share the personal information of consumers under 16 years of age. “Do Not Track.” Our website does not currently respond to browser “Do Not Track” signals.

Third-party links

The Service may link to third-party websites or services that we do not control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices.

Where information is processed

Our servers are located in the United States, and information is processed in the United States.

Changes to this Policy

We may update this Policy from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, ask you to re-accept. Your continued use of the Service after an update constitutes acceptance of the updated Policy.
