Liability Waiver, Release, and Assumption of Risk

Effective Date: June 2026

This Waiver applies to in-person classes, activities, and programs provided by Zhivaya Rech Studio (“the Studio”). It must be accepted by the parent or legal guardian of each participating child before the child attends in-person activities.

Participant and Guardian

By accepting this Waiver, I confirm that I am the parent or legal guardian of the child being enrolled and that I have the legal authority to accept this Waiver on the child’s behalf.

Acknowledgment and Assumption of Risk

I understand that participation in in-person classes and activities involves inherent risks, including the risk of physical injury. I voluntarily enroll my child in these activities and knowingly assume the inherent risks associated with participation.

Release of Liability

To the fullest extent permitted by California law, I release and agree to hold harmless the Studio, its owners, instructors, employees, and agents from claims for injury, loss, or damage arising out of my child’s participation in the Studio’s in-person activities that result from ordinary negligence.

This release does not apply to gross negligence, recklessness, or willful misconduct, and nothing in this Waiver limits any rights that cannot be waived under California law.

Indemnification

To the fullest extent permitted by California law, I agree to indemnify and reimburse the Studio, its owners, instructors, employees, and agents for any claims, losses, liabilities, or expenses (including reasonable legal fees) arising out of my child’s participation in the Studio’s in-person activities, except to the extent caused by the Studio’s gross negligence or willful misconduct.

Emergency Medical Authorization

In the event of an injury or medical emergency, and if I cannot be reached, I authorize the Studio to seek and obtain emergency medical care for my child. I understand that I am responsible for any resulting medical costs. I will inform the Studio in writing of any allergies, medical conditions, or medications relevant to my child’s safety.

Parental Authority

I represent that I have full legal authority to enroll the child and to accept this Waiver on the child’s behalf.

Severability

If any provision of this Waiver is found to be unenforceable or invalid under California law, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Governing Law

This Waiver is governed by the laws of the State of California.

Acceptance

By checking the acceptance box and confirming below, I acknowledge that I am the parent or legal guardian of the child, that I have read and understood this Waiver, and that I accept its terms on the child’s behalf. My acceptance is recorded electronically, with the date and time, and is associated with my account.
